Accusations - Sexual Misconduct | Medical Board of California
Medical care following a sexual assault
San Mateo County newspapers have recently publicized two criminal cases against physicians alleging sexual battery. Both physicians have lost patients and the respect of some of their colleagues. Without speculating on the degree of guilt or innocence in either case, it is fair to say that these two physicians will never enjoy their previous standing in the community after having these cases aired publicly in court. Since the Medical Board of California MBC may have a higher standard of ethics than the legal standard of the court, it is even possible that they will ultimately face Medical Board disciplinary measures. Also, it is possible that civil suits may award the alleged victims large settlements.
When Your Sexual Abuser Is Also Your Patient
Nurses are responsible for establishing and maintaining appropriate boundaries within their professional relationships with patients. When receiving care from a nurse, patients can expect their nurse to be professional, respectful, knowledgeable, skillful and ethical. Nurses are not allowed to engage in romantic or sexual relationships with their patients.
Sexual harassment is rampant in healthcare and responses to it are few and weak. In general, healthcare institutions are ill-prepared to comprehend the problem, to understand the contributions of their organizational culture, and to respond to sexual misconduct with direct, sure action and sufficient resources. They must undertake an array of bold actions to eliminate harassment and create a safe environment. Victims will only come forward if they feel safe doing so and know their report will result in a rapid, thorough, and fair investigation, and that their harassers will be punished, no matter their rank or reputation.
